Author: Dafalla, Abobakr Elkhair Ahmed
Abstract: This thesis is about remedies for breach of contract under Sudanese law in comparison with the Jordanian, Egyptian and English laws. It aims to examine and explore how the consecutive Sudanese laws handled the various remedies under consideration. The thesis comprises six chapters; four of which are dedicated to studying the remedies of; Damages, Liquidated Damages, Specific Performance and Termination. ChapterOne is an introductory chapter setting the overall structure for the thesis and Chapter Sixis the summary of the conclusions and the recommendations arrived at throughout the study. The emphasis in this thesis is laid on discussing some of the contemporary controversial issues pertinent to the above-mentioned remedies that have not yet satisfactorily been ventured into by the legal writers in Sudan and in the Middle East at large. After having comparatively studied these remedies, the researcher has identified some serious deficiencies in the current Sudanese Civil Transactions Act, 1984 regarding the way it handles the various remedies for breach of contract. Therefore, the researcher has come up with a number of recommendations calling for the necessity for introducing immediate legislative reforms to cure the current shortcomings of the said Act.
