Abstract

This study aims at explaining the basic elements of building a Muslim family as well as illustrating the differences in the views of religious scholars regarding family issues. A descriptive analytical approach has been used to show and explain the provisions of Shariah, jurisprudence and laws related to the family. The study consists of four chapters in addition to the most important findings and the list of references. The first chapter is entitled “STAGES OF FAMILY BUILDING” consisting of three sections, where the researcher defines the concept of family linguistically and conventionally, the concept of family system, the importance of marriage and engagement, the attributes of the engaged and many others issues related to stages of family formation. A comparison was between the concept of engagement in Islam, Christianity and Judaism. The second chapter is entitled “MARRIAGE, THE CONCPTS, THE PILLARS AND THE TERMS”. It contains four sections where the researcher defines marriage linguistically and conventionally , its terms , aptitude of the future husband , the unlawful marriages and other issues related to marriage. The third chapter is entitled “MARITAL FINANCIAL AND NON- FINANCIAL RIGHTS AND DUTIES ” it contains three sections where the researcher explains the concept of dowry linguistically and conventionally , then the couple expenditure , good treatment between the husband and wife, justice , obedience, the provisions regarding dowry and many other issues regarding marital rights and duties. The fourth chapter discusses “THE UPBRINGING OF CHILDREN IN ISLAM” as a basic element of family building. It contains six sections containing the definition of upbringing in Islam linguistically and conventionally, its types, and many other issues related to raising children. In the light of all what has been said, the researcher has come out with the following conclusions: God has given the rights of upbringing of children to the parents because of their innate knowledge of upbringing. But in case of the loss of the parents, upbringing rights are granted to the lawful guardian, e.g. grandparents or others. As for the expenditure on the wife, it depends on the financial status of the husband regardless of whether the wife is working or not
