حقوق الإنسان والشعوب في الإتحاد الإفريقي

Abstract

تختص هذه الدراسة بالبحث في شأن حقوق الإنسان والشعوب الواردة فى القانون التأسيسي لإنشاء الإتحاد الإفريقي، باعتباره مؤسسة إقليمية، يسعى إلى تحقيق وضمان هذه الحقوق من خلال مؤسساته وآلياته القانونية. إن الأهداف والمبادئ الواردة فى معاهدة الإتحاد اختلفت عما كانت عليه فى ميثاق منظمة الوحدة الإفريقية، وذلك إستجابة لمتطلبات العصر وحاجة الإنسان والشعوب في إفريقيا لمثل هذه الحقوق. تضمن الميثاق مبادئ مناهضة الاستعمار وتحقيق الاستقلال وعدم الانحياز ودعم حركات التحرر، فى حين نص القانون التأسيسي للاتحاد على تعزيز مبادئ حقوق الإنسان وتحقيق التنمية وإنشاء مؤسسات سياسية كبرلمان عموم إفريقيا ومؤسسات اقتصادية كالمصرف الإفريقي للإستثمار ومؤسسات قانونية كمحكمة العدل الإفريقية. تهدف الدراسة إلى إظهار الحقوق التى يجب أن يتمتع بها الإنسان والشعوب فى ظل القانون التأسيسي للاتحاد الإفريقي وذلك بدراسة نظرية حقوق الإنسان والشعوب وبيان مصادرها وأساسها وطبيعتها، والحقوق التى كفلتها معاهدة الاتحاد لأفراد وشعوب القارة والآليات القانونية والسياسية والاقتصادية التى نص عليها القانون التأسيسي للإتحاد الإفريقي لضمان حقوق الإنسان والشعوب. تم تقسيم البحث إلى ثلاثة أبواب، تناول الباب الأول نظرية حقوق الإنسان والشعوب والباب الثاني حقوق الإنسان والشعوب في المواثيق الإفريقية والباب الثالث ضمانات حقوق الإنسان والشعوب في الإتحاد الإفريقي. وقد خلص البحث الي النتائج والتوصيات الآتية: إن الإتحاد الإفريقي فضاء إقليمي للتعاون وضمان حقوق الإنسان والشعوب وجعل 􀂃 إفريقًا طرفًا موحدًا وفاع ً لا لنصرة القضايا العادلة والإنسانية في المؤسسات الدولية. تملك إفريقيا ثروات ومقدرات وأمامها تحديات تفرض على الإتحاد دراستها والأخذ 􀂃 بمفاهيم حقوق الإنسان والشعوب وتطويرها ونشرها. الأمن والسلام في إفريقيا حقوق في غاية الأهمية يتطلب من الإتحاد دعمها وإعتماد 􀂃 آليات إفريقية لإنهاء النزاعات وإخماد الحروب. على الإتحاد الإفريقي أن يواجه الأسباب الرئيسية وأن يعزز فعالية مؤسساته الضامنة 􀂃 لحقوق الإنسان والشعوب. عنوان الرسالة: حقوق الإنسان والشعوب في الإتحاد الإفريقي This research is devoted to human rights and rights of the people, and individuals as stated in the original document establishing the African Union as a regional organization for realizing and guaranteeing the said rights via its different organs.. The objectives in this Charter are different from those in its predecessor the Organization of African Unity as a consequences of the needs of the African people in the zeitgeist: The Charters include resenting colonization, achieving independence, neutrality and supporting liberation movements. While the law establishing of the Union provided human rights, development establishing democratic institutions i.e. Parliaments, economic institutions, i.e. the African Bank and legal forum, i.e, the African court. The research presents the rights which the individuals and the people should enjoy in the light of the charter establishing the Africa Union by studding the theory of human rights and the rights of the people to show its resources, its grounds and its nature as well as the rights preserved by the Charter for the individuals and the people of the Content and the legal, economic and political vehicles provided for by the Charter. The research is divided into three chapters: chapter one deals with the theory of the rights, while the second is concerned with the legal protection of the said rights. The third deals with the guarantees of the rights of nations and individuals. The results and recommendations of the research can be summarized as follows: ƒ The African Union is a regional entity for co-operation to guarantee human rights and the rights of the people and to support African unity in International Organizations in relation to justice and human rights. ƒ Africa has wealth and potentials and faces challenges which the African Union needs to study and develop and explore in the light of human rights and the rights of the people. ƒ Peace and security are rights of great importance and the African Union should support and adopt proper mechanisms to control disputes and prevent wars. ƒ The African Union should determine and confront the causes thereof and develop its organizations to guarantee the preservation of human rights and the rights of its people.
